Parship/Elitepartner: unwanted contract extensions and late cancellations

Whether you’ve booked a 6-, 12- or 24-month package, the company that runs Parship and Elitepartner, the PE Digital GmbH, causes problems with the cancellation. It is the erroneous opinion the contract is automatically extended by 12 months at a higher monthly cost if you do not cancel 12 weeks before it terminates. Thus from approx. 200 - 400 become gladly 800 - 1.000 €, which the people to Parship and/or elite partner are to pay. But this is just wrong.

To the legal situation

It is (in the literal sense) thousands of times judicially decided: Whether one has missed**, overlooked or forgotten the **termination period** or whether one cannot prove the receipt of the cancellation within the deadline, the contract is not extended. So you don’t have to cancel **at all**. It does not matter whether, when and why you cancelled or not. This means that customers who are affected will still get their money back years later, or will not have to pay for the renewal (refunds of payments from 2018 or before are time-barred, however). The legal situation for contracts from April 2022 is irrelevant: they do not have the problem at all.

But CAUTION: Don’t just do nothing - you must take action here if you want it to be safe.

Hamburg District Court and Regional Court: Consumers in the Right

The responsible district court Hamburg has ruled several times, for example on 16.2.2022 to the File number 317 S 26/21 that contracts with Parship / Elitepartner do not extend automatically. With similar result among other things also LG Hamburg 320 S 50/17 and 312 O 162/20.
Since April 2022 PE has always issued default judgments against itself, in order to avoid further court decisions in the matter.

The Hamburg District Court also regularly finds that the renewal clause is invalid. Exemplarily here three pixelated judgements for pdf download - these I will rarely update, because pixelating makes a lot of work:
