Based on my review of the client’s documents and evidence, the core concept involves, in part, making cold calls and sending cold emails—that is, calls and emails sent without the recipient’s consent. Such calls are illegal, even in the B2B sector. Furthermore, there are many indications in the contract that the Distance Selling Act (FernUSG) applies, so a closer examination is warranted here.
