How to deal with an unfair dismissal claim?

The dismissal has been announced – and immediately there is backlash. An unfair dismissal claim is on the table, the former employee is demanding severance pay or threatening legal action. Now it is important to remain calm. Any hasty reaction can exacerbate the situation.

Many employers are unaware that an early and well-considered strategy is crucial here. This is because the legal situation is rarely clear-cut – and often risky for employees as well. Those who remain objective and negotiate tactically can avoid costs, time and damage to their image.

A severance payment is not automatic. It can be a sensible solution – but only if it really solves the problem. Sometimes the smarter approach is to remain consistent. Sometimes, however, an amicable solution is the faster, cheaper and quieter way.
